Clarity Cremations - Terms and Conditions
Clarity Group Australia Pty Ltd (ACN 694 214 634) trading as Clarity Cremations (“we”, “us”, or “our”) provides online direct cremation services in Victoria, Australia.
By submitting an order or confirming arrangements with Clarity Cremations, you agree to be bound by these Terms and Conditions. These Terms are intended to be clear, fair, and legally compliant with Victorian and Australian law.
1. Nature of the Service
This agreement relates to a Direct Cremation with No Ceremony or Attendance.
The service includes:
- Transfer of the deceased into our care as soon as practicable
- Completion and coordination of all required legal and statutory documentation
- Liaison with medical practitioners, certifying authorities, and regulators as required
- Registration of the death with the Victorian Registry of Births, Deaths and Marriages
- Provision of a basic cremation coffin
- Cremation at a licensed crematorium selected by us
- Release of cremated remains (ashes) to the Authorised Person, subject to Section 7
The service does not include any funeral or memorial ceremony, viewing, attendance at the crematorium, embalming, dressing, or cosmetic preparation of the deceased.
2. Business Hours and Transfers
Our standard business hours are 9:00am to 5:00pm, Monday to Friday (excluding public holidays).
Transfers of the deceased occurring outside these hours, including evenings, weekends, or public holidays, may incur an additional fee. Any applicable surcharge will be disclosed to you prior to proceeding wherever practicable.
3. Cooling-Off Period, Cancellations and Refunds
A 24-hour cooling-off period applies from the time the order is submitted.
- If you cancel within the cooling-off period before transfer of the deceased has occurred, a full refund will be provided.
- If the deceased has already been transferred into our care during the cooling-off period, a $660.00 transfer fee will be deducted from any refund.
- No refunds are available once cremation documentation has been lodged with the relevant authorities or once cremation has commenced.
This cooling-off period operates in addition to any rights you may have under the Australian Consumer Law.
4. Authorised Person and Client Responsibilities
By placing this order, you warrant and confirm that you are the Authorised Person within the meaning of the Cemeteries and Crematoria Act 2003 (Vic) and have legal authority to arrange the cremation.
You agree to:
- Provide accurate, complete, and timely information about the deceased
- Cooperate with requests for documentation required by law
- Acknowledge that cremation cannot proceed until all statutory approvals are obtained
Required documentation may include (where applicable):
- Medical Certificate of Cause of Death
- Coroner’s Certificate
- Application for Cremation (Form 4)
- Death Registration documentation for Births, Deaths and Marriages Victoria
All arrangements are conducted online or remotely. No in-person consultation is included in this service.
5. Personal Effects
Unless we receive clear written instructions from the Authorised Person prior to cremation, all personal items provided with the deceased will be cremated.
If items are to be removed or returned, this must be confirmed by us in writing before cremation takes place.
We accept no responsibility for:
- Items cremated due to the absence of written instructions
- Undeclared or concealed items on or within the deceased
6. Use of Third-Party Providers
To deliver our services, we may engage licensed third-party providers, including funeral directors, transport providers, crematoria, and administrative service partners.
Clarity Cremations remains responsible for the overall coordination of the service to the extent required by law.
7. Handling and Delivery of Ashes
Cremated remains will be made available for collection from the partnered crematorium during business hours, or stored securely as instructed in writing by the Authorised Person.
Where requested in the online form / in writing or otherwise requested, ashes may be delivered by registered mail via Australia Post, in accordance with Australia Post’s conditions for the carriage of cremated remains.
By selecting postal delivery, the Authorised Person acknowledges and agrees that:
- Delivery timeframes are estimates only
- Once ashes are lodged with Postal Service, responsibility for delivery rests with the postal service
- Clarity Cremations is not responsible for delays, loss, or damage occurring during transit, except as required by law
If no written instruction regarding collection or delivery is received within 30 days of cremation, we will make reasonable attempts to contact the Authorised Person.
If the matter remains unresolved after 60 days, ashes may be retained in secure storage or transferred to the custody of a cemetery authority, in accordance with the Cemeteries and Crematoria Act 2003 (Vic).
8. Fees and Payment
- A full fee schedule is provided at the time of booking
- Payment must be made in full prior to cremation
- Any applicable surcharges will be clearly identified
Prices are subject to change where permitted by law, however confirmed bookings will not be affected.

10. Limitation of Liability
We will take reasonable care and skill in providing our services.
To the extent permitted by law:
- We are not liable for delays or failures caused by third parties, regulatory authorities, or events beyond our reasonable control
- Our liability is limited to resupply of the services or a refund, as determined under the Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees that cannot be excluded under law.
11. Privacy
Personal information is handled in accordance with our Privacy Policy, the Privacy Act 1988 (Cth), and where applicable, the Privacy and Data Protection Act 2014 (Vic).
Information is used solely for the purpose of providing funeral and cremation services or where required by law.
12. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia, including:
- Cemeteries and Crematoria Act 2003 (Vic)
- Births, Deaths and Marriages Registration Act 1996 (Vic)
- Australian Consumer Law
